1. Who this agreement is between

These Terms of Service ("Terms") are a legal agreement between you ("Subscriber," "you") and OdaBookings ("we," "us," "our"), governing your access to and use of the OdaBookings platform, including our website, admin dashboard, guest booking widget, and all related software (collectively, the "Service").

2. Intellectual property — ownership and restrictions

The Service, including its source code, database structure, user interface design, visual identity (including the OdaBookings name and logo), documentation, and all underlying technology, is the exclusive property of OdaBookings and is protected by copyright, trademark, and other intellectual property laws of India and applicable international treaties.

You may not, and may not permit others to:

• Copy, reproduce, modify, or create derivative works of the Service or any part of its source code, design, or branding;
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service;
• Scrape, crawl, or systematically extract data, design elements, or functionality from the Service for the purpose of building a competing product;
• Use the OdaBookings name, logo, or trademarks without our prior written consent;
• Resell, sublicense, rent, or otherwise make the Service available to any third party outside the scope of your own subscription.

Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your own property's bookings, staff management, and related operations — it does not transfer any ownership of the underlying platform to you.

3. Your data

You retain full ownership of the data you input into the Service, including guest bookings, staff records, financial entries, and property information ("Customer Data"). We act as a data processor for this information and will not use, sell, or share Customer Data except as necessary to provide the Service or as required by law.

4. Subscription, billing, and cancellation

The Service is offered on a subscription basis across Silver, Gold, and Platinum tiers, billed monthly in advance. You may upgrade, downgrade, or cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing cycle; we do not provide partial-period refunds except as described in our Refund Policy.

5. Acceptable use

You agree to use the Service only for lawful hospitality business operations. You may not use the Service to store or process content that is illegal, fraudulent, or infringes the rights of others.

6. Limitation of liability

The Service is provided "as is." To the maximum extent permitted by law, OdaBookings shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service, including loss of revenue or data, except where such liability cannot be excluded under applicable law.

7. Termination

We may suspend or terminate your access to the Service if you violate these Terms, including the intellectual property restrictions in Section 2, without prior notice in cases of serious or repeated violation.

8. Governing law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Gujarat, India.
